By using this site, you agree to adhere to the Terms & Conditions, which become effective upon your first use.

In no event will ELFC be liable to any person for any damage or loss that may arise from the use of any information contained in our site or products displayed on our site, including, without limitation, indirect or consequential damages, or any damages whatsoever arising from use or loss of use, data, or profits, whether in action of contract, negligence or other tortious action, arising out of or in connection with the use of the site.

Notwithstanding anything else in these Terms & Conditions, we will not be liable for claims relating to the functionality or availability of this site. ELFC is authorized and regulated by the Securities and Exchange Commission (SEC) to operate as a financing company only.

The Client certifies that all information provided are complete, true, and correct and the Client understands that any misrepresentation or failure to disclose information, submit or support a required document may cause the disapproval of the application or the cancellation of approval if granted. The Client authorizes Esperanza Loyola Finance Corporation (“ELFC”) to obtain and/or verify: (a) any information contained in this form and the documents submitted; and (b) obtain additional information with government agencies and other institutions / individuals. For this purpose, Client authorizes the sources from which the ELFC may obtain information to provide the same to the ELFC.

The Client authorizes the ELFC: (a) to obtain information from other banks and financial institutions mentioned in this application as may be necessary or required for purposes of evaluating this application; (b) to request information regarding the status of any court case to which the Client is a party. The authorization granted by the Client is intended to be the written consent / permission required under the provisions of R.A. 1405 as amended (Law on Secrecy of Bank Deposits), R.A. 6426 (Foreign Currency Deposit Act) and any other law relating to the secrecy of bank deposits.

Client acknowledges that he/she applied for the loan under a reasonable comprehensive understanding of the financial product being availed and that Client has been duly advised regarding the nature, structure, terms and conditions, as well as the financial product’s fundamental benefits and risks. Client acknowledges that Client had the opportunity to seek and was not prevented nor discouraged by the ELFC from seeking independent legal and financial advice prior to his/her loan application or execution and delivery of any agreement and documentation.

Undertaking

I/We hereby agree to comply with the loan application and requirements subject to Bangko Sentral ng Pilipinas (BSP) and Securities and Exchange Commission (SEC) circulars, rules and regulations, and policies of Esperanza Loyola Finance Corporation.

I/We authorize ELFC or any of its authorized representatives to call, enter, inspect, and take photos of my/our premises as part of its credit verification procedures.

I/We agree and consent that ELFC may collect, use, disclose, process, retain or dispose my/our personal information in compliance with the Data Privacy Act (R.A. No. 10173).

I/We acknowledge and consent that my/our personal data may be disclosed by ELFC to its third-party service providers for use on behalf of ELFC.

I/We consent to the collection and processing of other data like identification info, telco data, and loan performance data for credit scoring, eKYC, and fraud detection purposes.

I/We agree that the application form remains ELFC property and may be used for loan application, insurance, and promotional activities. Personal data will be retained in compliance with AMLA.

I/We bind ourselves to the terms of the Promissory Note with Chattel Mortgage upon loan acceptance, including all applicable charges.

I/We authorize ELFC to verify information with government agencies (e.g., BIR, LTO, PhilHealth, RD) for identity and financial validation.

I/We agree that false or fraudulent documentation may lead to immediate loan termination and repayment demands.

I/We authorize ELFC to contact me/us through SMS, email, or other means for updates related to loans.

I/We authorize ELFC to debit affiliated bank accounts to settle dues including penalties and other charges.

I/We authorize ELFC to disclose my/our credit data to Credit Information Corporation and related credit bureaus.

I/We waive rights under the Writ of Habeas Data and acknowledge ELFC may revoke the loan application at its sole discretion.

I/We acknowledge the right to withdraw consent under the Data Privacy Act of 2012.

I/We certify that all information provided is true and authorize ELFC to verify such information with other institutions.
